Caveats
A Caveat is a warning or caution registered against the Certificate of Title and will prevent any further dealings with the property.
Caveats on a property
In South Australia, caveats can be lodged over land if you have an equitable (‘real’) connection with the land in question.
It is not possible to lodge a caveat over another person’s land ‘simply because they owe you money’.
Some of the equitable reasons for which a caveat can be lodged are:
- unregistered mortgages
- unregistered leases
- Contract of Sale and Purchase of the land which is still to settle
- claims of contributing to the land by a party to the relationship
- beneficiary to a Will
- Government Authorities for unpaid rates and taxes
